Heard learned counsel for the applicant.
The instant contempt petition has been filed for violation of the order dated 18 September 2017 passed in Second Appeal No. 1491 of 1990 (Ghanshyam vs. Bairagi). The appeal came to be dismissed.
It is urged that after dismissal of the appeal, applicant, the decree holder, has filed proceedings for execution of the decree. It is further urged that opposite parties have filed a fresh suit and are delaying the execution proceedings.
In my opinion, the instant contempt petition is misconceived and accordingly, dismissed with liberty to the applicant to pursue the execution case.
