. Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of writ of Mandamus declaring that the action, things and deeds of the Respondents in not handover the vacant possession of Shop No.8, situated in Ground Floor, Alekhya Residency, H.No.1-8-703 to 712, University Road, Nallakunta, Hyderabad is illegal, irregular, un-constitutional, against to the principles of natural justice and in violation of Articles 14, 19, 21 and 300-A of the Constitution of India and consequently direct the Respondents to handover the vacant possession of Shop No.8, situated in Ground Floor, Alekhya Residency, H.No. 1-8-703 to 712, University Road, Nallakunta, Hyderabad and also direct the Respondents to pay damages @ 3,500/- per month since April, 2005 and enhancement @ 10% on every year on monthly rent till the date of delivery of possession to the petitioner.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and the order of the High Court dated 24-4-2014 made herein and upon hearing the arguments of Sri Narasimha Rao Gudiseva, Advocate for the Petitioner and G.P. for Home for Respondent Nos.1 to 5, the Court made the following ORDER:
The Assistant Commissioner of Police, Central Crime Station is present and he would assure this Court that in the presence of the petitioner, the locks applied to the shoproom will be opened before 05.00 in this evening and vacant possession of the shoproom will also be delivered to the petitioner today.
Post on 03rd June 2014 ‘for Judgment’.
