This writ petition under Article 226 of the Constitution of India has been filed on behalf of petitioner seeking the quashing of impugned judgment and order dated 08.02.2018 passed by the respondent no.2 in Case No."C-201805000000046" (Baiju Pandey @ Amrtansh pandey vs. Sub-Divisional Magistrate (R&R), Deoria, u/s 3/4 of the U.P. Goonda Control Act 1970 as well as order dated 24.11.2017 passed by the respondent no.3 in Case No."D-2017052000304" and Case No."D-
20140520001418" u/s 3/4 of U.P. Goonda Control Act 1970, Village Nonar pandey, P.S.-Bankata, District Deoria.
Heard Shri Rajesh Kumar Dubey, holding brief of Shri Satish Mohan Tiwari, learned counsel for the petitioner and learned A.G.A. and also perused the record.
Counsel for the petitioner has not been able to point out any such illegality or breach of any constitutional provision which may persuade this Court to interfere in the impugned orders. The appeal filed in the court of Commissioner was beyond the period of limitation and could not have been entertained therefore. A brief reference to the nature of allegations and the merits does not mean that the appeal has been dismissed on merits which would have required a detailed appreciation of facts. In the facts and circumstances of the case there is no good ground for this Court to exercise its inherent power under Article 226 of the Constitution of India.
The petition lacks merit and therefore same stands dismissed.
