The petitioner, owner of a stage carriage bearing registration No.KL-2/W 5333 applied for temporary permit on the route Chavara- Elampalloor in the vacancy of stage carriage bearing registration No.KL-13/B 7099 by Ext.P1. The petitioner prays for issuance of temporary permit to his stage carriage No.KL-2/W 5333 on the aforesaid route in the vacant timings of stage carriage bearing No.KL-13/B 7099. 2. If vacancy of stage carriage bearing registration No.KL-13/B 7099 is still in existence and no other person has applied for a temporary permit to operate a stage carriage in that vacancy, there shall be a direction to the respondent to issue a temporary permit of four months duration within one week from the date of WP(C).34261/14 2 production of a copy of this judgment by passing appropriate orders on Ext.P1. Needless to say, such issuance of temporary permit will be subject to the preferential claim, if any.
