Heard learned counsel for the petitioner and learned Standing Counsel for the respondent- State.
With the consent of the counsels for the parties the writ petition is finally disposed of.
The claim of the petitioner is that there is an order passed by Tehsildar dated 03.02.2017, by which order the Tehsildar has directed for immediate removal of the respondent no. 5- Paras Nath S/o Shankar from the public property being Gata No. 82M, Rakba 0.003 hectare, which according to the map is the land of Gaon Sabha shown as GARAHI.
According to the counsel for the petitioner though the order of removal against the respondent no. 5 from the public property has been passed by the Tehsildar on 03.02.2017 but no steps are yet taken for actual removal of the respondent no. 5 from the said property.
Learned counsel for the petitioner has submitted that in this regard he has approached the District Magistrate, Sant Ravidas Nagar (Bhadohi) but no heed was paid on his representations.
Having heard the counsels for the parties, the writ petition is disposed of by directing the respondent no. 2- District Magistrate, Sant Ravidas Nagar (Bhadohi) to take a decision on the representations of the petitioner and in case if there is no other order is passed by any higher authority, the order of the Tehsildar should be complied with preferably within a period of two months from the date the certified copy of this order is produced before him.
The writ petition is disposed of.
