JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) Mr.Hardik Rawal, learned counsel appearing for the respondent Corporation wants to file additional affidavit in LPA No.996 of 2011 wherein he wants to bring to notice the fact that illegally the appellant has not paid the licence fees or increased licence fees. etc. as per the terms of the contract or conditions of renewal and therefore, GSRTC has to pay licence fees to the Municipal Corporation to the tune of Rs.15 lacs without realising the amount from the appellant without entering into contract and orders with regard to contract renewal or court's order and what steps have been taken by the respondent Corporation shall be filed alongwith additional affidavit and it shall also be clearly stated in the affidavit to be filed by some responsible officer, wherein it shall also be explained that if the appellant was a defaulter, why and how the contract was subsequently awarded to him and renewed from time to time. He shall also file a further reply to the additional affidavit filed by the appellant duly sworn in July,2011. Two affidavits shall be filed by the respondent alongwith record.
2. At the joint request of the learned counsel for the parties, list these matters on 11.4.2012, but affidavits shall be served on or before 9.4.2012. Learned counsel for the parties have fairly stated that they will not seek adjournment or adjournment will not be granted on the ground of leave note or sick note.
