Heard Sri Sudarshan Singh, learned counsel for the applicant and learned AGA for the State.
Learned counsel for the applicant has filed Criminal Misc. Correction Application No. 2 of 2018 for permission to amend the bail application as well as affidavit, filed in support of bail application. The same is taken on record.
Learned counsel for the applicant has submitted that due to typing mistake a Section 120B IPC was not added in bail application.
From perusal of record, it transpires that the bail application was filed for bail of Bahoran in Case Crime No. 151 of 2018 under Section 302, 201 IPC, P.S. Fatehganj East, Distt. Bareilly whereas the applicant was detained in judicial custody under Section 302, 201 and 120B IPC.
Learned AGA has no objection if this correction application is allowed.
In the interest of justice, correction application filed by the applicant is allowed.
Learned counsel for the applicant is permitted to correct/amend the bail application dated 2.11.2018 today itself. In order dated 4.12.2018 passed by this Court, Section 120B also be added in para-1 and para-8.
