JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule.
Learned APP, Mr.Pandya, waives service of Rule on behalf of respondent No.1 - State.
By way of this application, the applicant has prayed that he be enlarged on temporary bail for the purpose of sale of his land.
From jail remarks, we find that the applicant was already on temporary bail in January,2012 itself. Further from the papers annexed with the application, we do not find any authenticated material based on which it can be said that any agreement to sell has been entered into by the applicant - convict.
Considering the totality of the facts, discretion does not deserve to be exercised. Hence, the application is rejected. Rule is discharged.
