JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) Rule.
Mr.J.K. Shah, learned Additional Public Prosecutor waives service of rule on behalf of the respondent-State.
2. The applicant- appellant- original accused has been convicted for the offences punishable under sections 302 and 201 of the Indian Penal Code to suffer imprisonment for life with fine of Rs.50,500/- in default to suffer further imprisonment for 3 years and 3 months, by the learned Judge, Additional Sessions Court, Kheda, at Nadiad, in Sessions Case No.97 of 2009.
3. The applicant by way of this application seeks temporary bail for a period of 45 days to enable him to arrange financial assistance to his family. The learned APP has made available the Jail record.
4. Taking into consideration the above aspects, the applicant is ordered to be released on temporary bail for a period of 30 (thirty) days from the date of his release on his executing a personal bond of Rs.5000/- (Rupees five thousand only) with one surety of the like amount to the satisfaction of the Jail authorities.
5. The applicant shall surrender himself to the Jail authorities on expiry of the above temporary bail period.
6. The application is allowed. Rule is made absolute.
