Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.
Learned counsel for the applicant contended that in the First Information Report no role was assigned to the applicant. Specific role of firing was assigned to co-accused Raju Singh Parihar and as per allegations, co-accused Bhurey Singh Parihar assaulted with Sariya. However the role of catching hold was assigned to the applicant in the alleged statement recorded under Section 161 Cr.P.C. There is no criminal history of the applicant. However, he is in jail since 24.1.2010.
In this view of the matter, without expressing any opinion on merits of the case, let the applicant namely, Bahadur Nai be released on bail in Case Crime No. 130 of 2010, under Sections 307/504 I.P.C., P.S. Sumerpur, District Hamirpur on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Court concerned.
