Heard Sri Siddharth Khare, learned counsel for the petitioners and Sri D.N.Mishra, learned Standing Counsel for the respondents.
This contempt application has been filed alleging wilful disobedience of the order of the writ Court dated 5.12.2011 passed in Writ-A No.69981 of 2011 (Bagheshwari Prasad and others v. State of U.P. and others), which is reproduced below:
"Consequently, liberty is given to the petitioners to represent their claim before the Secretary, Audyogik Vikas Anubhag-1, Government of U.P. Lucknow. In the event of any such representation being moved on behalf of the petitioners, said authority shall consider the grievance of the petitioners and take appropriate decision in the matter, in accordance with law, preferably within a period of four months from the date of receipt of representation along with a certified copy of this order.
Writ petition stands disposed of accordingly."
In compliance to the order of the writ Court, the concerned authority has passed order dated 3.9.2012, Corrigendum order dated 19.8.2019 and the order dated 20.8.2019. Copy of the order dated 19.8.2019 and 20.8.2019 have been filed as Annexures 1 and 2 to the affidavit of compliance of Sri Gaurav Dayal, Director, Industries U.P., Kanpur, dated 5.9.2019.
Two affidavits of compliance both dated 28.11.2019 have been filed today, which are taken on record.
Perusal of the affidavits of compliance show that the order of the writ Court has been complied with and the payments have also been made.
In view of the aforesaid, I do not find any good reason to proceed further with this contempt application. Consequently, the contempt application is disposed of.
