Heard learned counsel for the petitioners and learned Standing Counsel for the State-respondents.
The petitioner is seeking regularization of Group-D post with respondent-establishment on the ground that the claim of the petitioners comes within the provisions of Rule of Regularization of Group D Employees on Daily Wage Basis Rules, 2001, (hereinafter referred to as the 'Rules, 2001') and in this regard, they approached the authorities, several times, but for one reason or the other, their grievance could not be redressed.
Under the circumstances, it will not be fruitful to keep this petition pending.
Let the matter be examined, at the first instance, at the level of respondent No. 2, who shall consider the claim of the petitioner in conformity with the provisions of Rules, 2001, after getting the records straight from the office concerned, where the petitioners have been engaged and after due verification, if it is found that the petitioners are entitled to be regularized in service, appropriate order shall be passed in that regard.
In any event, entire exercise shall be carried out within a period of three months from the date of production of a certified copy of this order.
Writ petition stands disposed of with the aforesaid observations and directions.
