Heard the counsel for the petitioner and the counsel for respondent nos. 3, 4 & 5.
The petitioner has filed the present writ petition against the order dated 29.07.1999 passed by the Settlement Officer of Consolidation and the order dated 22.06.2011 passed by the Deputy Director of Consolidation, Fatehpur whereby the Deputy Director of Consolidation affirmed the order dated 31.07.2009. Though the aforesaid orders, the Settlement Officer of Consolidation has chuked out Plot Nos. 288 and 286 on the ground that the said plots were adjacent to road and shops have been constructed on Plot No. 286. The Petitioner has only 1/4 share in the plots purchased by respondent no. 6 in the aforesaid plots while respondent nos. 3 to 5 claims 3/4 share in the disputed plots.
The appeal was filed by the respondents claiming a chak on the aforesaid plots on the basis of their share in the same but the Settlement Officer of Consolidation by his order dated 31.07.2009 has chucked out the said plots from the consolidation proceedings.
There is no illegality in the orders passed by the Consolidation Authorities and it is not a fit case for interference by this Court under Article 226 of the Constitution of India.
The writ petition is dismissed.
