Heard learned counsel for the petitioner, learned Standing Counsel for State-respondents and Sri Habib Ahmad, learned counsel for respondent No. 4.
Sri Habib Ahmad and learned Standing Counsel pointed out that earlier petitioner has filed Writ-C No. 19101 of 2018 which was disposed of by this Court on 25.05.2018 with direction to District Magistrate to decide the representation of the petitioner.
As per letter of Additional District Magistrate, Sonebhadra, representation of the petitioner was decided on 19.07.2018 which is not under challenge and present petition has been filed with the same relief which was prayed in Writ-C No. 19101 of 2018, therefore, present petition is not maintainable.
Learned counsel for the petitioner submitted that he may be permitted to withdraw the present petition with liberty to challenge the order dated 19.07.2018 passed by District Magistrate.
Accordingly, writ petition is dismissed with the aforesaid relief.
