Heard, the learned counsel for the applicants, the learned AGA for the State and perused the record.
The present bail application has been moved by the applicants Badre Muneer and Imran alias Behari in Special Case No. 96 of 2009 arising out of case crime no. 1111 of 2009, under Section 392 and 411 IPC P.S. Maudha, District Hamirpur, with a prayer that he may be admitted to bail. The FIR was registered on 08.10.2009 against unknown persons with regard to the incident of snatching of bag containing cash, mobile and driving license.
It is contended by the learned counsel for the applicants, that money has been recovered from the possession of the applicants on the date of arrest which belongs to him. He was arrested from his house and has been falsely implicated in the present case. The applicant is absolutely innocent person and he has no criminal history. The applicant is in jail since 08.10.2009 and in case he is enlarged on bail he will not misuse the liberty of bail. In view of the aforesaid facts and circumstances, without expressing any opinion about the merits of the case, let the applicants, Badre Muneer and Imran alias Behari involved in Special Case No. 96 of 2009 arising out of case crime no. 1111 of 2009, under Section 392 and 411 IPC P.S. Maudha, District Hamirpur be enlarged on bail, on their executing a personal bond and furnishing two heavy sureties each in the like amount to the satisfaction of the court concerned, with the following conditions:-
(i)The applicants will not tamper with the evidence during the trial.
(ii)The applicants will not pressurise/ intimidate the prosecution witness.
(iii)The applicants will appear before the trial court on the date fixed. In defiance of the above conditions, the prosecution would be at liberty to move application for cancellation of bail.
