ORDER:
The grievance of the petitioner in this Writ Petition is that even though the stay application filed by him before respondent No.5 in the Revision Petition, which is filed against the order, dated 31.10.2013, in C.M.A.No.19 of 2011 passed by respondent No.1, is pending and no order has been passed thereon, respondent No.3 is seeking to evict him from the lands in question.
After hearing the learned counsel for the petitioner and the learned Assistant Government Pleader for Social Welfare, I am of the opinion that the interests of justice would be met if respondent No.5 is directed to dispose of the Revision Petition filed by the petitioner in a time bound manner and respondent No.3 is directed not to interfere with the petitioner’s possession of the property comprised in Hec.0.35, 4.48 and 1.70 in Survey Nos.445/1, 440 and 439, respectively, of Indukuru Village, Devipatnam Mandal, East Godavari District, till the disposal of the Revision Petition.
Accordingly, respondent No.5 is directed to dispose of the Revision Petition stated to have been filed by the petitioner within a period of two months from the date of receipt of a copy of this order, after giving notice to the petitioner and that respondent No.3 is restrained from dispossessing the petitioner from the above-mentioned property till the disposal of the Revision Petition by respondent No.5.
Subject to the above directions, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, W.P.M.P.No.1486 of 2014 is disposed of as infructuous.
