It is evident from order dated 28-07-2011 passed by this Court that notice has been issued in the petition on 28-7-2011, making it returnable on 9-8-2011. While passing the order, the Court has directed the respondents-authorities to answer the specific allegations made on page 6, paragraph-g of the memorandum of the petition, to the effect that adjoining land owners, who are the recipients of impugned notices, have not been visited with drastic steps such as contemplated against the petitioner. It is submitted by Dr.Mukul Sinha, learned advocate for the petitioner, that the owner of the adjoining land, namely, one Shri Ismailbhai has been granted Non-agricultural use permission by order dated 23-10-2008 of respondent No.2 whereas the orders regarding non-agricultural use permission in respect of the land of the petitioner have been kept in abeyance.
Respondent No.2 has not cared to file an affidavit-in-reply in respect of the express directions of this Court. The affidavit-in-reply, be filed and the query of the court, as contained in order dated 28-07-2011, be addressed in the said affidavit, which should be filed on, or before, the next date of hearing.
