Devendrappa, Adv. for R1 and R2) …Respondents This writ petition is filed under Articles 226 and 227 of the Constitution of India praying to direct the respondents to pass appropriate order upon the petitioner’s legal notice dated 25.02.2015 vide Annexure-C and direct the respondents to fix the assessment for the petitioner’s property and to issue katha in the name of the petitioner for the said property.
This writ petition coming on for preliminary hearing ‘B’ group this day, the court made the following:
ORDER Petitioner who is claiming to be the purchaser of Site No.30 in a layout formed in Sy. No.110 of Kempapura Agahara, Kasaba Hobli, Bangalore North Taluk in Corporation Ward No.22, presently situated at 1st Cross, Mariyappanapalya, K. P. Agrahara, BBMP Ward No.120, Bangalore 560023, has sought for an appropriate direction to the respondent – BBMP to decide upon the petitioner’s representation at Annexure-C dated 25.02.2015.
2. Learned counsel for the respondent – BBMP submits that an endorsement has been issued on 11.05.2017 calling upon the petitioner to furnish certain additional documents.
3. Impleading application – I.A.1/2016 has been filed and a claim is sought to be made as regards the property in question.
4. However, learned counsel for the respondent – BBMP submits that necessary action would be taken on the representation at Annexure-C that has been submitted by the petitioner.
5. For the purpose of disposal of the representation of the petitioner, respondent – BBMP can call upon the petitioner to produce such other documents as may be necessary. In light of the undertaking given by the learned counsel appearing on behalf of BBMP to consider the representation no further orders are called for.
6. Accordingly, the writ petition is disposed of directing the respondent – BBMP to complete the consideration of the representation of the petitioner within a period of twelve weeks from today. Impleading applicant is at liberty to place his claim before the respondent – BBMP which shall be considered and disposed of by the BBMP in accordance with law.
Impleading application – I.A.1/2016 being opposed, without expressing any opinion on the merits of the applicant’s case in light of liberty granted to the impleading applicant to appear before the BBMP, no orders are called for as regards the application and the same is disposed of as requiring no further orders.
