Petitioner's father late Mahak Singh was a Driver in U.P.S.R.T.C. and was murdered on 4.10.2010. Petitioner asserts that he was minor then and in the absence of anyone else available in the family was looked after by his maternal grandparents. According to petitioner, he has now become major and has moved an application for release of retiral benefits and also for grant of compassionate appointment.
When the petition was entertained, time was granted to the counsel for the respondents to obtain instructions on 3.9.2021. Sri Rahul Agarwal for the Corporation on the basis of instructions obtained submits that the petitioner has not yet made a proper application before the Corporation annexing relevant materials which may demonstrate that the family continues to remain in penury so as to condone the delay occasioned in filing of application for compassionate appointment. It is also stated that if petitioner furnishes relevant materials, his claim for release of financial benefits would also be considered.
In the facts of the present case petitioner is therefore permitted to approach respondent no. 3 alongwith necessary details and facts which may demonstrate that the family continues to suffer despite expiry of more than 10 years of the death of the employee and for release of financial benefits. Such application shall be considered within a period of six weeks from the date of presentation of a copy of this order. In the event any further documents are required from the petitioner, the Corporation shall intimate him so that necessary action would be taken at his instance.
With the above directions, this writ petition stands disposed off.
