(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present application is filed by wife of the convict, who is at present on temporary bail pursuant to order of this Court dated 20th June 2012 in Criminal Misc. Application No.8378 of 2012. It is mentioned in para 3 of the application that on 3rd July 2012, near Hansalpur Cross Roads, the convict met with an accident and became unconscious and he was taken to Lion M.C. Shah Orthopedic Hospital, Viramgam, and from there the convict was referred to V.S. Hospital. Three days after hospitalization and on his regaining consciousness the convict was discharged from the hospital and was asked to come for medical check up on 15th July 2012. The party-in-person, i.e. wife of the convict states that when the convict visited the hospital for check up, the doctor was not present and the convict was asked to come on 18th July 2012.
2. In support of the application papers from Lion M.C. Shah Orthopedic Hospital, Viramgam and Sheth V.S. Hospital, Ahmedabad are annexed to this application.
3. RULE.
Mr.H.K. Patel, learned Additional Public Prosecutor waives service of rule on behalf of the respondent-State.
4. For the contents of the application, the same is allowed. Temporary bail granted by this Court by order dated 20th June 2012 in Criminal Misc. Application No.8378 of 2012 is extended by 30 (thirty) days, on the same terms and conditions.
5. The convict shall surrender himself to the Jail authorities on expiry of the extended period of temporary bail period. Rule is made absolute. The Registry is directed to communicate this order to the Jail authorities by fax.
