BELOW OFFICE NOTE
1. The office has circulated a note dated 12.7.2012 upon receipt of request dated 29.6.2012 and 21.6.2012 requesting for extension of time received from the learned Principal District Judge, Kheda at Nadiad. After office note was placed for appropriate orders, note has been adjourned on couple of occasions i.e. 16.7.2012 and 19.7.2012.
2. However, leaned advocate for the original petitioner and / or opponent have repeatedly not remained present and have not opposed request made by the learned Court of 8th Additional Senior Civil Judge and Additional Chief Judicial Magistrate, Nadiad for extension of time, despite the fact that to allow opportunity to petitioner and respondent the mater has been adjourned on 16.7.2012 and 19.7.2012.
3. After having granted opportunity to the original petitioner and the opponent to remain present and make submission with reference to the request received from the Learned Principal District Judge, Kheda at Nadiad, present order is passed after taking note of continuous and consistent absence of learned advocate for the petitioner as well as learned advocate for the respondent.
4. Under order dated 22.10.2010 learned trial Court was requested to decide the suit proceedings as expeditiously as possible and preferably within 18 months from the date of the order. It appears that learned trial Court has not been able to conclude proceeding within time limit mentioned in the said order dated 22.10.2010. For the reasons mentioned in the communication dated 21.6.2012 learned trial Court has requested for extension for further 12 months.
5. As mentioned above the request is not opposed by the petitioner and / or respondent.
6. Having regard to the facts and circumstances of the case, extension of time is granted and learned trial Court is requested to adjudicate and finally decide Suit Nos. 276 of 2008, 241 of 2008 and 283 of 2008 as expeditiously as possible and preferably by 15.1.2013.
With the aforesaid clarification the office note dated 12.7.2012 is disposed of.
