JUDGMENT / ORDER

The petitioners have filed this writ petition challenging the increased rate of hostel charges and recover the amount from the inmates retrospectively. The petitioners submit that they were staying in the hostel and were paying the charges applicable at the time of admission. Ext.P2 is the notice which would show the rate of rent applicable at the time of admission. It does not reserve any right to the respondents to enhance rate of rent retrospectively. However, without further notice, the rate has been increased. I am of the view, retrospective claim of enhanced charges cannot be levied from the petitioner. The petitioner if at all liable to pay only the prospective charges of the room. Considering the fact that this writ petition is filed in the year 2005 and there are no inmates who were occupying at WP(C).No.34725/2005-H.
2 that point of time presently continuing this hostel, this writ petition is allowed quashing the impugned orders. However, it is made clear that this will not a bar for the authorities for claiming enhanced rate for any year thereafter.
