Heard learned counsel for the petitioner and learned Standing Counsel appearing for the State respondents.
Sri K.K. Mani has accepted notice on behalf of the Gaon Sabha.
Present petition has been filed seeking direction in the nature of mandamus to suspend the order / decree dated 26.10.2020 and 31.10.2020 passed by the respondent no. 2 in Case No. 567/2017 Computerized Case No. T20170150703567 (Bachchu Singh and others vs. Pappu and others) under Section 116 of U.P. Revenue Code, 2006.
Perusal of Annexure-4 to the petition reflects that although the appeal was filed on 4.11.2020, however, as admitted the same is pending admission and has not been allotted any number.
Attention was drawn to Annexure-5 to the petition, which is a notice dated 17.11.2020 for dakhal paimaish. Submission is that consideration of application for grant of interim order is urgent, which may be decided expeditiously.
In the facts and circumstances of the case, present petition stands disposed of with a direction to the respondent no. 1-Additional Commissioner, Agra Region, Agra to take up the appeal for admission as well as for consideration of stay application and at least the stay application may be decided as expeditiously as possible preferably within a period of three weeks from the date of filing of self attested copy of this order before him, which may be verified from the official website of this Court.
It is further provided that the demarcation if any carried out shall not be given effect to for a period of one month or till the disposal of the stay application, whichever is earlier.
It is needless to add that all efforts shall be made by the appellate authority to decide the appeal also as expeditiously as possible.
With the aforesaid observations, present petition stands disposed of.
