Heard learned counsels for the parties.
By means of this application U/s 482 Cr.P.C., the applicant has prayed for expeditious disposal of the trial in connection with Criminal Case No. 1736 of 2018, State v. Mukesh Singh & Others, arising out of Case Crime No. 029 of 2018, under Sections 447, 457, 427 IPC, Police Station Suhwal, District Ghazipur pending in the court of Chief Judicial Magistrate, Ghazipur pursuant to charge sheet submitted only on 06.05.2018.
It has been argued on behalf of the applicant that the court below is taking lenient view of the matter and in spite of service of summons, and application being moved by the present applicant for taking appropriate action, only bailable warrant has been issued and the opposite party nos. 2 to 4 who are in illegal possession of house of the applicant are virtually avoiding their appearance in the criminal case.
Be that as it may, the criminal case is of May 2018 only and therefore, no time bound schedule can be provided for disposal of pending criminal case. However, it is hereby provided that the court below shall proceed in accordance with law and shall endeavour for expeditious disposal of the criminal case without granting unnecessary adjournment to either of the parties and as and when required may also take appropriate steps for ensuring appearance of witnesses and recording of oral evidence.
With the aforesaid directions, the present 482 Cr.P.C. application is hereby disposed of.
