Heard learned counsel for the parties.
Petitioner was working as clerk in the office of the fifth respondent-District Supply Officer, Ballia. Petitioner came to be retired on attaining the age of superannuation on 31 December 2018. It is urged that the disciplinary proceedings pending against the petitioner has since concluded.
By the instant writ petition, petitioner seeks following relief:
i) to issue a writ order or direction in the nature of mandamus directing the respondents no. 4 and 5 who shall ensure to pay the post retiral benefit (pension, G.P.F., Gratuity, Insurance claim) of the petitioner forthwith within stipulated period;
ii) to issue any other suitable writ, order or direction as this Hon;ble Court deems fit and proper in the facts and circumstances of the case.
Learned Standing Counsel submits that the fifth respondent respondent shall pass appropriate order, in accordance with law.
In view thereof, on consent, the petition is disposed of directing the fifth respondent--District Supply Officer, Ballia, to consider and decide the claim of the petitioner by reasoned and speaking order, expeditiously, preferably within a period of three months from the date of filing of certified copy of this order alongwith copy of the writ petition.
It is clarified that the Court has not considered the claim of the petitioner on merits.
