This is second habeas corpus writ petition filed by petitioner no.1. The earlier petition bearing Habeas Corpus Writ Petition No.238 of 2019 was eventually disposed of.
It appears that the corpus of petitioner no.2 was handed over to petitioner no.1 but it seems that the petitioner no.1 has no control over the daughter and now again she has ran away to respondent no.4.
The FIR to this effect was lodged as case crime no. 9 of 2019 and the police after holding the investigation submitted charge sheet under Section 363, 366 and 376(2)(i) IPC and Section 3/4 POCSO Act against Lavkush, son of respondent no.4, who is presently languishing in jail in connection with aforementioned case crime number.
It appears that petitioner no.1 has no control over his daughter and that is why the repeated habeas corpus writ petition are being filed by him. The police has also ceased the matter, I do not find any good reason to exercise power under Article 226 of the Constitution of India, accordingly, the present habeas corpus writ petition is dismissed.
