Heard counsel for the petitioner and AGA for State.
By the order dated 18.1.2019, the petitioner was granted time to file the papers showing his title over plot no. 1094 (Ga) area 05 Bigha, which is disputed land in the present case but the requires papers could not be filed by the petitioner.
The writ petition has been filed for quashing the FIR dated 27.4.2018 registered as Case Crime No. 22 of 2018, under Section 419, 420, 467, 468, 471, 120 B IPC, P.S. Raipur, Distt.
Sonbhadra.
In substance of FIR the allegation has been made that the land in dispute belongs to ancestors of the first informant and by making forgery in the revenue record it was grabbed by the petitioner.
We have considered the arguments of the counsel for the parties.
A perusal of the FIR indicates that it discloses the cognizable offence as such it is not liable to be quashed at this stage.
However, if the petitioner surrenders and applies for bail then same shall be considered and decided expeditiously, in accordance with law.
