Bachan vs Vashishtha Rai & Another

High Court Of Judicature at Allahabad|23 September, 2010

JUDGMENT / ORDER

No one appears in support of this appeal. I have gone through the Substitution Application No.18686 of 2003, which has been filed on behalf of Sochan and another alleging themselves to be appellant nos. 2 and 3. The appeal is only on behalf of one appellant i.e. Bechan who has died. The application for substitution has been moved alleging that he has died leaving behind appellant nos. 2 and 3 as his real brother and daughter. There are no appellants no.2 and 3 in this appeal, therefore, to this extent the application is wholly misconceived and deserves to be rejected. The heirs and legal representatives of the appellants, if any, have not come forward to seek their substitution. In view of above, the application is highly misconceived and is rejected.
The appellants having died as far back as on 18.12.2002 as stated in paragraph 2 of the affidavit in support of the above application, the appeal does not survive and stands abated.
