Heard learned counsel for the petitioner.
The petitioner has filed an application dated 4.5.2018 under Section 95(1)(g) of the Uttar Pradesh Panchayat Raj Act, 1947 (hereinafter referred to as, 'Act, 1947') read with Rule 3 of the Uttar Pradesh Panchayat Raj (Removal of Pradhans, Up-Pradhans and Members) Enquiry Rules, 1997 before respondent No. 2, i.e., District Magistrate, District- Jaunpur demanding an enquiry against respondent No. 6, who is the elected Gram Pradhan of the village. It has been stated that the aforesaid application/complaint submitted by the petitioner is still pending before respondent No. 2, who has not yet taken any decision on the same.
It would serve no purpose to keep the writ petition pending. The writ petition is disposed of with a direction to the District Magistrate, District-Jaunpur, i.e., respondent No. 2 to take appropriate decision in accordance with law on the application/complaint dated 4.5.2018 submitted by the petitioner after verifying whether the aforesaid complaint is in accordance with the statutory requirements provided in Rule 3 of the Uttar Pradesh Panchayat Raj (Removal of Pradhans, Up-Pradhans and Members) Enquiry Rules, 1997 within a period of six months from the date a certified copy of this order is produced before him.
