JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Rule.
Mr.Patel, learned APP waives service of notice of Rule.
The present application has been preferred by the applicant - convict, through his wife, for temporary bail on the ground that he wants to attend the baby shower ceremony of the wife of the brother-in-law of the applicant - convict.
The party-in-person, wife of the applicant - convict is present in the Court and she additionally states that the GPF amount, which was to be withdrawn has not been so far released by the authority and, therefore, alternatively the applicant - convict may be released for such purpose.
It appears from the jail report that the applicant - convict was released in the month of May 2012 for the very reason for 15 days and, therefore, temporary bail does not deserve to be granted for the same ground, but it is observed and directed that the jail authority shall pursue the matter for ensuring that if the withdrawal of GPF is permissible to the applicant - convict, the amount of withdrawal is so availed and is credited in the bank account of the applicant - convict. The ground of attending baby shower ceremony is not such where the presence of the applicant - convict can be said as indispensable.
Hence, subject to the aforesaid observations and directions, the present application is disposed of. Rule discharged.
