Heard Shri Manvendra Singh, learned counsel for the petitioners, Shri A.K. Sand, learned AGA for the State and perused the record.
This petition has been filed by the petitioners with a prayer to quash the F.I.R. dated 29.07.2018 registered as Case Crime No.235 of 2018, under sections 323, 324, 504, 506 IPC, PS Malwan, District Fatehpur.
Learned counsel for the petitioners submits that the role of causing injuries to the sole injured has been assigned to only petitioner No. 1, Baburam.
Learned A.G.A. opposed the prayer for quashing the FIR.
After having heard learned counsel for the parties present and perused the impugned FIR as well as the other material brought on record, we dispose of this writ petition with the following directions :-
(i) Investigation of the aforesaid case shall go on but petitioner nos. 2 to 4, namely, Dharmesh, Bachchilal and Kamta Prasad shall not be arrested in the aforesaid case till the submission of police report under Section 173(2) Cr.P.C., subject to their cooperation during investigation.
(ii) As far as petitioner no. 1, Baburam is concerned, the petition stand dismissed.
