Heard Sri R.C. Srivastava for the petitioner and Sri Manoj Nigam for respondent-bank.
The petitioner is disputing of taking loan from the respondent- bank. On the other hand the counsel for the respondent-bank states that a fresh loan agreement has been executed by the petitioner.
Since highly disputed question of fact is involved in the writ petition, which requires oral as well as documentary evidence, therefore the disputed question of fact cannot be decided in the writ petition.
The writ petition is dismissed with liberty to file a suit.
