Petitioner superannuated in the year 2010 from the post of Accountant in the State Treasury at Firozabad. He was initially appointed on 7.4.1979. Benefit of first promotional pay scale was granted w.e.f. 1.1.2000. It is stated that persons similarly placed as petitioner were granted second promotional pay scale and were placed in the grade pay of Rs.5400/- w.e.f. 1.12.2008 but such benefit has been denied to the petitioner. It is stated that petitioner has been placed in the grade pay of Rs.4800 and the benefit of second promotional pay scale has not been granted from the date such benefit is granted to other similarly placed persons. A representation in that regard has been made before the authority concerned on which an endorsement was made to take appropriate decision, but according to the petitioner, no final orders have been passed.
Sri S. K. Dubey, learned Additional Chief Standing Counsel submits that an appropriate decision would be taken by the competent authority in case a decision has not already been taken.
In the aforesaid facts and circumstances, this writ petition stands disposed of permitting the petitioner to approach respondent no.2 by making a representation in respect of his grievance, noticed above, alongwith certified copy of this order, annexing all materials in support of his claim, within a period of three weeks from today. In case such a claim is raised, the same shall be examined by the authority concerned and an appropriate order would be passed, in accordance with law, within a further period of three months thereafter.
