Heard learned counsel for the petitioners and perused the record.
In view of the order proposed to be passed, notice need not issue to the respondent.
The petitioner is before this Court for a direction to the Additional Civil Judge IV, Varanasi to decide the temporary injunction application 6-C filed by the petitioner/plaintiff under Order XXXIX Rule 1 & 2 CPC in Original Suit No. 632 of 2018 (Babulal vs. Smt. Chinta Devi) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Additional Civil Judge IV, Varanasi to consider and decide the aforesaid application in accordance with law expeditiously and preferably within a period of three months from the date of production of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
