Heard learned counsel for the petitioner.
Presently and from the record it appears that in the suit which is pending, an application for temporary injunction is yet to be disposed of. The order sheet reveals that the opposite parties are yet to be served and put to notice. It is further evident that the petitioner has not even made any request or prayer before the concerned trial Judge to consider grant of injunction ex parte and awaiting notice.
In view of the above, this petition shall stand disposed of with liberty to the petitioner-plaintiff to approach the concerned Court for grant of ex parte relief. It is further clarified that this Court has not considered the merits of the application which is proposed to be made.
