The present writ petition has been filed challenging the orders dated 19.4.2021 and 23.6.2021 passed by the Deputy District Magistrate, Sakaldeeha, District Chandauli and the Board of Revenue, Uttar Pradesh at Allahabad.
The facts of the case are that an appeal was filed by the petitioner as well as one Hriday Narain Singh. Subsequently, the petitioner filed an application for permission to withdraw the said appeal. The second appellant, i.e., Hriday Narain Singh did not file any application for withdrawing the appeal and was ready to continue with the hearing of the appeal. The application filed by the petitioner has been dismissed on the ground that even if one appellant is interested in prosecuting the appeal, the appeal cannot be dismissed as withdrawn. The Board of Revenue has affirmed the said order.
There is no illegality in the orders passed by the revenue courts. The writ petition lacks merit and is, hereby, dismissed.
