(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) 1. We have heard Mr. D.S. Vasavada, learned counsel appearing for the appellant – original respondent No.1.
2. This Letters Patent Appeal has been filed challenging the interim order dated 16.3.2012 passed by the learned Single Judge in Special Civil Application No.18943 of 2011 whereby the learned Single Judge has admitted the writ petition and has expedited and has granted interim relief.
3. In our opinion, no interference is called for in the impugned order of the learned Single Judge. It is always open for the appellant to move an application before the learned Single Judge requesting for fixing early date of hearing of the writ petition.
4. In the result, this Letters Patent Appeal fails and is accordingly dismissed.
In view of dismissal of appeal, Civil Application for stay does not survive and is accordingly dismissed.
