Babublal vs Director

High Court Of Gujarat|03 October, 2012

JUDGMENT / ORDER

(Per : HONOURABLE THE CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) Pursuant to our earlier direction, today, separate affidavits have been used; one by the Union of India and another by the National Aids Control Organization [NACO].
Since Mr. Shalin Mehta, the learned Sr. Advocate appointed by this Court as amicus curiae is appearing for the first time and he wants some time for doing research work on this subject, we adjourn the matter for a fortnight.
It appears from the affidavit given by the Union of India that it has relied upon the view of the National Institute of Biologicals [NIB] for testing the biologicals, in support of their view that PCR method is not advisable and we, therefore, propose to consider the view of the NIB and accordingly, direct the National Institute of Biologicals to give an affidavit pursuant to our earlier direction dated September 18, 2012. Mr. Champaneri, the learned Assistant Solicitor General of India submits that he will convey this decision and will see that such affidavit is given by the NIB within a fortnight from today. Let the matter appear on October 19, 2012.
Henceforth, the name of Mr. Shalin Mehta, should appear as amicus curiae in WP [PIL] No. 156 of 2012 and Civil Application No. 10354 of 2012.
