This Civil Application has been filed in Special Civil Application No. 7784 of 2008 which is pending before this Court for a long time for final hearing.
It appears that the present applicant is the original respondent no.1 who is aggrieved by the fact that on the oral undertaking extended by the learned advocate initially, the petitioners-opponents herein are not proceeding with SCA No. 7784 of 2008 and resultantly, Regular Civil Suit No. 154 of 2005 pending before the learned Principal Civil Judge, Kalol is also not proceeding on account of this Special Civil Application. Therefore, the request made in the present Civil Application for fixing early date for final hearing is acceded to. The matter ie., Special Civil Application No. 7784 of 2008 is peremptorily fixed for hearing on 2nd May 2012. Rest of the prayers since are already incorporated in another Civil Application preferred by this petitioner in Civil Application No. 9703 of 2011, the same are not being considered at this stage.
Office is directed to place Special Civil Application No. 7784 of 2008 on the stipulated date. Needless to reiterate that there is already a specific order made earlier in this regard by the Court [Coram : C.L Soni, J.] on 16th January 2012.
Civil Application stands disposed of accordingly.
