1. By way of this petition, the petitioner has prayed to quash and set aside the impugned award dated 04.02.2003 passed by the Industrial Tribunal in Reference [ITN] No. 532/1991, whereby the Tribunal has directed the respondent to Board to reinstate the petitioner on his original post with continuity of service and 75% of the back wages.
2. Heard learned counsel for the respective parties. The learned counsel for the respective parties states that the matter is settled between the parties. As per the said settlement, the learned counsel for the petitioner Board states that the petitioner will pay an amount of Rs.2,70,000/ in lieu of the reinstatement with continuity and back wages and that said payment will be treated as full and final settlement of all the dues of the respondent. In view of the aforesaid statement, the petitioner Board is directed to pay an amount of Rs.2,70,000/ in lieu of the award granting reinstatement with continuity and back wages. The said payment shall be treated as full and final settlement of all the dues of the respondent. The said payment to be made within a period of four weeks from today. The amount shall be paid by A/c Payee Cheque equally to each of the legal heirs of the deceased respondent, after proper verification.
3. With the above observations and directions, the petition stands disposed of. Rule is made absolute to the above extent.
