Ramachandran Nair, J. Petitioner herein is the respondent in O.P.1936 of 2012 of the Family Court, Nedumangad. The main prayer in the petition is for a direction to the Family Court to consider and pass orders on Ext.P2 (I.A. No.135 of 2014) and Ext.P3 (I.A No.136 of 2014) within a time limit to be fixed by this Court. It is clear from the averments in the petition that an exparte decree has been passed against the petitioner and to set aside the same, Ext.P2 has been filed and to condone the delay, Ext.P3 application has been filed. Ext.P4 is the objections filed by the respondent to Ext.P2. In the meanwhile, E.P.95 of 2013 has been filed by the respondent. Ext.P6 is the order passed by the Family Court directing to issue warrant against the petitioner.
2. When this petition came up for admission, we called for a report from the Family Court, Nedumangad. Report of the Family Court dated 14.10.2014 is received, in which the learned O.P(F.C) No.485 of 2014-R 2 Judge has stated that I.A.Nos.135/2014 and 136/2014 are posted to 14.11.2014 for objection and hearing. It is submitted by the learned counsel for the petitioner that the petitioner is ready to give oral evidence in support of the application and the last posting date was on 04.10.2014. But since there was no sitting, it was adjourned to 14.11.2014, which is confirmed in the report furnished by the Family Court also. The learned Judge has stated that I.A.Nos.135 of 2014 and 136 of 2014 will be disposed of within one month. We direct the Family Court to expedite the hearing and disposal of the I.A Nos.135 of 2014 and 136 of 2014 after giving opportunities to both sides. Till the orders are passed, further action pursuant to Ext.P6 will be kept in abeyance. The petitioner will produce a certified copy of the judgment before the Family Court.
The O.P(F.C) is disposed of as above.
