This appeal is against the order dated 25th June, 2018 passed by learned single Bench in Writ-A No.14116 of 2018. The petition aforesaid was filed giving challenge to the order dated 11th June, 2018 whereby the appellant-petitioner was accommodated as Helper at Anpara Thermal Project, District Sonbhadra on closure of Panki Thermal Project.
Learned single Bench while dismissing the petition for writ arrived at the conclusion that the employer decided to accommodate the appellant-petitioner in sister concern and that does not suffers from any error.
In appeal, learned counsel appearing on behalf of the appellant- petitioner states that the appellant-petitioner has been adjusted at a lower post then the post he was holding at Panki Thermal Project.
Having considered the statement given by learned counsel for the appellant, we deem it appropriate to dispose of this appeal by affirming the order passed by learned single Bench but keeping the appellant-petitioner at liberty to agitate his cause before the respondents for his accommodation on an equivalent post to the post held by him in Panki Thermal Project, if any such post exists in the project where he has been transferred.
With the observations as above, the appeal stands disposed of.
