The prayer made in the instant petition is for issuing direction to the trial court to decide Misc. Case No. 5/74/2009 within a specified time frame.
The case is under Order 39 Rule 2-A CPC. A perusal of order sheet reveals that the opposite party has already entered appearance and is contesting the proceedings.
Counsel for the petitioner points out that there is already a direction by this Court in an earlier petition under Article 227 bearing No.7014 of 2016 for deciding the said case within a period of eight months.
In that case, a second petition for the same relief is not maintainable.
The petition is accordingly dismissed.
