Heard Shri S.K. Tripathi, Advocate holding brief of Shri Baleshwar Chaturvedi, learned counsel for the opposite party.
The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the order dated 21.09.2012 passed in Writ Petition No.44421 of 2012.
An affidavit of compliance has been filed by the opposite party. In paragraph-4 of the compliance affidavit it is stated that pursuant to the order passed by this Court, the respondent no. 3 has issued an order dated 12.02.2013 whereby the order of punishment of dismissal from service dated 16.08.2012 passed against the petitioner has been cancelled and the situation prevailing prior to order of punishment of dismissal dated 16.08.2012 has been restored, copy of which is appended as annexure-1 to the affidavit of compliance. Therefore no further orders are required to be passed.
In view of the same, the present contempt application is dismissed.
