Heard learned counsel for the parties and perused the record.
This application has been filed under Section 482 Cr.P.C. for directing the Chief Judicial Magistrate, Ambedkar Nagar to dispose of the Final Report No.11 of 2008, under Sections 302, 201, 504, 506 I.P.C., P.S. Akbarpur, District Ambedkar Nagar expeditiously within a stipulated period.
The learned counsel for the applicant submitted that in Case Crime No. 552 of 2007, under Section 302, 201, 504, 506 I.P.C., P.S. Akbarpur, District Ambedkar Nagar was registered and after the investigation, the final report was filed by the investigating officer but till today, no order has been passed by the court below on the final report.
Learned counsel for the applicant also submitted that in pursuance of the circular issued by Allahabad High Court dated 11.12.2012, to direct the court below to dispose of the cases in which final reports are filed by the police on priority basis, if possible, within the period of three months from the date of its submission.
Learned A.G.A. has no objection, in case the application is finally disposed of with the direction.
Considering the aforementioned facts and circumstances of the case, the Chief Judicial Magistrate, Ambedkar Nagar is directed to take decision on the Final Report No. 11 of 2008 dated 04.12.2007 submitted by the investigating officer in Case Crime No. 552 of 2007 within a period of two months from the date of production of certified copy of the order.
The application is finally disposed of.
