Heard Virendra Singh, learned counsel for the petitioners, Shri Anurag Srivastava, learned Standing Counsel for the State respondents and Shri Ramesh Chandra Upadhyay, learned counsel for forth and fifth respondents.
Petitioner is before this Court with the request to command the respondents to ensure Amal Daramad of the agricultural lease dated 27.10.1983 by the L.M.C., which was approved by Sub Divisional Officer, Martniganj, Azamgarh on 02.07.1984 granted in favour of petitioners over plot no.162M area 200 Kari, Plot no.479 area 148 Kari in favour of first petitioner and plot no.485 area 269 Kari in favour of second petitioner, plot no.629 area 164 Kari in favour of third petitioner situated in Chiksawan, Pargana Mahul, Tehsil Phoolpur, District Allahabad.
Learned counsel for the petitioner submits that the aforesaid relief as has been asked for in the backdrop that the proceeding under Section 198(4) UPZA&LR Act 1950 has been finalized by an order dated 18.09.2017 whereupon the Commissioner, Azamgarh Region, Azamgarh has allowed the revision and as such, request has been made that once the revision has been allowed in favour of petitioner, then in such a situation, the Sub Divisional Officer, Martniganj, Azamgarh may be asked to mutate the name of petitioner in the revenue records.
Considering the facts and circumstances of the case, this Court is of the considered opinion that no fruitful purpose would be served in keeping the writ petition pending and with the consent of the parties, the same is disposed of finally with the direction to the Sub Divisional Officer, Martniganj, Azamgarh to look into the grievance of the petitioner and pass appropriate order within six weeks from the date of production of certified copy of this order.
