Heard learned counsel for the petitioner and Shri Brij Kumar Yadav for the Gaon Sabha, respondent no.3 as also learned Standing Counsel for the State-respondents.
The writ petition has been filed seeking the following relief -
I. To issue a writ, order or direction in the nature of mandamus directing to the respondent no.2 to remove the encroachment from the Gata No.638 which situated at marginal boundary of revenue village Gopalpur and revenue village Haseran, Pargana Sakatpur, Tehsil Tirwa, District Kannauj.
In case, the petitioner complains of encroachment upon a chak road as is submitted, he may invoke Section 26 of the U.P. Revenue Code, 2006 and file an appropriate application before the Tehsildar for redressal of his grievance.
Subject to the above, this writ petition stands disposed of.
