Heard learned counsel for the applicant and learned Standing Counsel.
The applicant has preferred the present contempt petition for non-compliance of the judgment and order dated 23.05.2018 passed in Writ A No. 6386 of 2008 (Babu Ram Sharma Vs. State of U.P. and others).
An affidavit of compliance has been filed by the opposite party on 16.01.2019 in paragraph 6 of the aforesaid affidavit, it is stated that pursuant to the order passed by this Court a decision has been taken by opposite party on 14.01.2019. It is further argued that pursuant to the aforesaid order services of the petitioner was also regularized, as per the direction issued by this Court.
From the perusal of the same, it is argued that order passed by the Writ Court has been complied with in its letter and spirit. No further orders are required to be passed in the present contempt application.
At this point of time, it is argued by learned counsel for the applicant to permit him withdraw the present contempt petition as not pressed with a liberty to challenge the order passed by opposite party dated 14.01.2019 and subsequent orders thereafter, by taking appropriate legal forum.
Permission made is allowed to withdraw the present petition as not pressed with a liberty as prayed before appropriate forum.
