Heard learned counsel for the petitioners, Sri Rajesh Yadav, learned counsel representing the respondent no.5, Gaon Sabha and learned Standing Counsel for the respondent no.4.
With the consent of learned counsel for the parties, the writ petition is disposed of.
The contention of learned counsel for the petitioner is that the revision filed under Section 210 of U.P. Revenue Code, 2006 filed on 19.07.2018 is pending before the Additional Commissioner (Administration), Saharanpur Division, Saharanpur.
Learned counsel for the petitioners has submitted that the court of the Additional Commissioner (Administration), Saharanpur Division, Saharanpur is non-functional for the reason that certain people are not participating in the proceeding pending before the said respondent no.2. In this regard, the petitioner has specifically stated in paragraph 40 of the writ petition.
In view of the aforesaid, it is hereby directed that the respondent no.2 to proceed and decide the revision filed on 19.07.2018, in accordance with law, preferably within a period of three months from the date of production of certified copy of this order without granting any unnecessary adjournment to either of the parties.
In case any of the parties sought an adjournment, the same may be considered, in accordance with law for a short period on payment of cost of rupees one thousand.
The writ petition is disposed of.
