Hon'ble Vishnu Chandra Gupta,J.
Heard Sri Rajiv Singh, learned counsel for the petitioner and learned A.G.A.
This petition has been filed with a prayer that a suitable direction may be issued to ensure the fair investigation of case crime No. 5 of 2014 under section 302 IPC, P.S. Kandhai, District Pratapgarh.
From the perusal of the counter affidavit it reveals that in the present case for proper investigation S.P. Pratapgarh has transmitted the material to DIG Lucknow with the report that the material be sent to Maharashtra State where alleged incident occurred for proper investigation.
therefore, this petition become infractuous.
Accordingly this petition is disposed of.
